There are times you have to wonder if some of the members of the Idaho Legislature have a clue what they're doing -- or for that matter if any of them actually passed a basic high school government class.
There are members who don't believe the laws that apply to the rest of us apply to them (like paying their state taxes). Some want to return to the gold standard to pay debts (imagine everyone having to have measuring devices for gold and up-to-the minute prices on what gold is worth). But the latest idiocy comes from those who want to invoke the principle of "nullification." Nullification is an arcane concept that's gotten new life recently from 10th Amendment extremists. Essentially, it says each state has the right to individually "nullify" any federal law its legislatures don't consider to be constitutional. Forget that the 10th Amendment essentially died on the battlefields of the Civil War. Forget for a moment that the people pushing this concept usually call themselves "constitutionalists," meaning they claim to understand the Constitution better than the Supreme Court, the legal ultimate arbitrator of what the Constitution means. Article VI, Paragraph 2 of the Constitution says that "This Constitution, and the Laws of the United States which shall be made in pursuance thereof... shall be the supreme Law of the Land...." Therefore, if state laws and federal law conflict, the federal law must be followed by the citizens and the courts. Nullification has NEVER been upheld by any court with the power to rule on the Constitution. If states can pick and choose from the smorgasbord of federal law then we no longer have a republic, we would have a confederacy. It took our founding fathers less than eight years to realize that a confederation just wouldn't work and to adopt the current Constitution creating a federal republic. Apparently, some of our legislators haven't passed U.S. history classes, either. The federal courts, and ultimately the Supreme Court of the United States, determine if a law is constitutional or not. If the legislature doesn't like a federal law, it can direct the state's attorney general to sue in federal court to challenge the constitutionality of that federal law. That is the proper procedure. Idaho, for example, is one of several states that sued over key provisions of the new health care law and so far the states seem to be winning in the federal courts. Sure, there are times the federal government seems a little heavy handed, but remember that no law was passed unless a majority of the elected representatives of the people agreed to do so. That's the basic principal of our government. If you don't like a federal law, either change those representatives or sue in federal court. Keep in mind, though, that the leaders in D.C., as well as leaders in various states from time to time, BREAK their own OATH OF OFFICE, everytime they push for some that is UN-Constitutional.
The people should be under NO obligation to obey any government that won't even honor its OWN oaths.
Take twenty minutes. Just twenty minutes, to ALSO read our Declaration of Independence.
Being taxed without our consent, it's also about our rights and liberties, and our DUTY to abolish any government that would intrude into such.
Standing armies, which might well fall under this "Civilian Army" scheme, erecting multiple new offices to harass our people.......there are a TON of things to read in those twenty minutes, that apply today...........and would give the American citiens EVERY RIGHT to tell this government where to stuff it!
Take the twenty minutes to ingest CAREFULLY, what our founders wrote.
Out of date? Maybe, but they had just FOUGHT THEIR WAY OUT FROM UNDER.........where we are headed right now, if politicians continue to operate "unchecked."

As for the civil rights movement discrediting nullification, would you say the internment of the Japanese discredits the federal government? If not, why not? Why the double standard?
Abolitionists used nullification to fight against the fugitive-slave laws. Would you have told them to take a hike, too?

That you consider the Supremacy Clause to refute nullification essentially says you are not entitled to an opinion. This is an error unworthy of a second grader. Seriously. You think Jefferson was unaware of the Supremacy Clause?
The Declaration of Independence was a petition of greivance...in essence, an "up yours" letter sent to the Crown.
Between that declaration and the ratification of the U.S. Constitution, there occurred a few years of warfare and political negotiations before our Republic received it's stamp of approval.

Actually, the last "guy" that attempted nullification was the state of Montana in an effort to stop the Obama administration from getting their hooks into guns and ammo made in that state. The Firearms Freedom Act, first introduced in Montana, seeks to disregard regulations imposed by the ATF. The claim is that if the weapon is manufactured and kept within the state then it is beyond regulation of the federal government.
As Jefferson warned, if the federal government is allowed to hold a monopoly on determining the extent of its own powers, we have no right to be surprised when it keeps discovering new ones. If the federal government has the exclusive right to judge the extent of its own powers, it will continue to grow -- regardless of elections, the separation of powers, and other much-touted limits on government power.
Two dozen American states nullified the REAL ID Act of 2005. More than a dozen states have successfully defied the federal government over medical marijuana. Nullification initiatives of all kinds, involving the recent health care legislation, cap and trade, and the Second Amendment are popping up everywhere.
Nullification is an important defense mechanism for a free people, with deep roots in American history -- albeit American history no one is taught in school. So you see, Kelly, this aint a joke and no one is "kidding".
The examples you cite were pending laws, or laws contested and settled in court. That process has begun with health care reform. But asserting that no matter the outcome, the states have the right to reject the outcome is tantamount to Faubus' racist assertion that his stste need not adhere to the federal government's recognition that all persons, regardless of race, have equal status. That is the same as saying that no matter the US Constitution, states may enact any law they wish. Quite simply, it has clearly been shown, after the Civil War, that is not the case.
The states must adhere to our Constitution, but when the FEDS pass laws that are OUTSIDE of our Constitution...........or that go AGAINST our Constitution, why should we STILL be under some kind of obligation to go along with it? That's adhering to the POLITICIANS...........not our Constitution.
Getting elected to public office, doesn't make ANY of better better than us.
When you start intruding on rights, try to squelch free speech, start taking things over, imposing mandates and threatening fines if folks don't pay up..............well..........some people might be indoctrinated to believe they have to bow to everything these corrupt characters come up with..............because "the government SAYS we have to do it."
But WHO works for WHO?
If Senator Crapo came to town to hold a town hall meeting (and I wish he WOULD)..........and he ran a RED LIGHT down on 10th & American Legion------and a cop pulled him over.............
I would expect Crapo to get the SAME TICKET any one of US would get.
Nowhere in our Constitution or Bill of Rights, does it EXCLUDE the "Washington Elite." So when these band of jackals impose crap upon us that is contrary to what is SUPPOSED to be..........the STATES have EVERY RIGHT to protect ITSELF and it's CITIZENS from it.
What's happening right now in Arizona (for example), is a TRAVESTY, and a lot of other states watching it, are merely "gearing up" so it doesn't happen HERE.
This administration thinks that just because it is currently in power, it can just make up its own rules as it goes along.
That's what King George thought too, about 240 years ago.
Finally, let me ask an open question to all..............if there is TRULY "No Taxation Without Representation."..............and the Congress does NOT do the will of the people, are they truly "representing" us?
I don't think so, and I for one, do not believe they ae entitled to a DIME of our tax dollars until they do.

I clearly was NOT asserting that states don't have to go along with CONSTITUTIONAL law. I was merely stating that nullification is a practice that is still used today, and often is the catalyst that makes our politicians think twice before they enact laws that dont pass the constitutional sniff test. I have zero problem with nullification, and see it for what it is, an important defense mechanism for a free people.

IT is funny to me when the courts go the rights way its great but if it goes any other way the judge is activist,stop it.The thing that bothers me is i have no faith in the supreme court as it sits right now. If Federal law was the supreme "last word" in the land, there would be no need for STATE LAWS. There are state laws because "one size doesn't fit all."
The "administration" doesn't just mean the White House--------it is the entire regime, to include the Congress & Senate.
The "King George" I was talking about was the ENGLISH King during the revolutionary times. George Bush certainly pulled his share of screw-ups, and I have HAMMERED on that even to the dismay of my fellow "Republicans" (and I use that term VERY loosely).
But among all this "change" there was gonna be, one of the BIGGIES was that it was no longer going to be "business as usual." Uh-huh.

The D.O.I. can be read very objectively in less than 30 minutes. What makes this document so important and so clear, is that it lists the VERY REASONS our founders finally said "ENOUGH!"
Politicians have been violating us for years, and have been able to do it, because there haven't been ENOUGH of us that have taken the time to read "the rules"............we just "elect, and sadly RE-elct them"............trusting THEM to tell us what is right & wrong.
The Government is NOT our "mommy & daddy". Just because Bush, Cheney, Obama or Biden say something, that doesn't make it "gospel." Never HAS! Everytime the Congress convenes, it's little more than a mobster's convention. The only time things run halfway well, is when they are GONE on vacation!
FEW.............and I mean FEW........congressional representatives EVER take the time to hold townhall meetings in their states...........so HOW, pray tell, can they claim to know what their "constituents" actually want or need?
The GOVERNORS are generally the ones who know BEST what is going on in their state, because of all the HEAT that flows into their offices and across their desks.---------AND THEY DON'T GET TO VOTE on the crap that comes out of D.C.
Some states have different tax laws and spending policies than others, which is why some of them are BANKRUPT today, while others flourish.
States with the toughest gun laws, continually have the highest crime rates to go WITH it.
Auto insurance is usually lower in states where there aren't as many accidents.

Remember that old system?......those yokels sitting there in that big dark room in 1224, with the huge status boards, and radios------trying to DICTATE to the ramp what needed to be done...........and they didn't even have a WINDOW to SEE out of.........they had absolutely NO CONCEPT of what was actually going ON out there, but they were trying to call all the shots.
You and I were out there, though. WE ON THE RAMP.........Yellow/Blue/Green/Red........WE knew what needed to be done, because WE were the ones OUT there making it happen. We flew airplanes and we dropped bombs, often in SPITE of of the little "Sheriff's Posse" in Job Control.
Red/Yellow/Blue/Green-----------------------Idaho/South Dakota/Vermont/Arkansas............same concept. The government does NOT know what is best for each state.........if they DID, there's be NO NEED for governors.
The government is there to WORK FOR US-----------that's why we pay them with our tax dollars.
I do not support this administration anymore than I did George Bush's.............and that is at LEAST a FIFTY-FIFTY slice!

Churchill worked closely with Roosevelt, Thatcher worked with Reagan, and Blair backed our play, even when it was unpopular with his own people to do so. They've been good allies.

Sounds like conflicting reports, and it IS a little strange that ABC (which as Eagle Eye says, IS a left wing site), reported the same word I got. I heard it on FOX Saturday morning, but it was on one of the morning programs, not with Hannity or O'Reilly.
The report from the Independentco, cites an existing treaty, as you and I discussed earlier on the phone today, which may indeed have stemmed from Jimmy Carter's SALT II treaty.
One thing that bugs me about it, though.......it calls for the Russians to be able to verify OUR side, but I didn't see anything going the other way. Did you?
Anyway, if this is just a mere extension of Carter's sellout, we certainly can't hold Obama to the fire for it, and I'm not too proud to admit that.

Yes, under an earlier START protocol, Russia got notice of the TRANSFER of nukes to places like Britain. But what they DID NOT get was unique identifiers such as serial numbers that they NOW will get under this new START program. These serial numbers will quantify and specify EXACTLY what we give Britain and anyone else.
Now tell me, is it a good idea to be MORE transparent with Russia than you are with the people of America? Yet another bad move by Obama is what this amounts to.
