Continuance issued in Nutter case

On Jan. 31, a preliminary hearing was scheduled in the case of Joseph Nutter.

Nutter is currently being held in the Elmore County jail on charges of lewd conduct with a child under 16 and forcible sexual penetration by use of a foreign object.

During the hearing it was stated that a motion had been filed to assign a conflict attorney in the case and a motion was granted issuing a continuance of the hearing in order to give the new defense attorney a chance to go through discovery in the case.

Prosecution did not oppose the request and a new hearing was set for Feb. 15 at 3 p.m.
