AG Labrador Sues Biden Administration To Reverse WOTUS Rule

2.27.23 - Boise, ID – Attorney General Raúl Labrador has joined the Texas-led lawsuit to protect Idaho from the Biden Administration’s unlawful overreach. On December 30th, 2022, the EPA announced it had finalized a rule establishing a definition of Waters of the United States (WOTUS) which redefines waterways subject to federal regulation. This proposal will be used by the federal government to gain control of Idaho’s land and resources.

The rule change ignores Congress’ express will and expands federal authority by lumping minor water features like streams, ponds, and wetlands that cross state lines with traditional waters. With its unique waterways, Idaho would be subject to increased federal government interference. This would pose a massive regulatory barrier for Idaho’s farmers, ranchers, and small businesses that depend on unfettered access to Idaho’s resources. EPA’s proposed rule will be effective as of March 20th.

This unlawful federal encroachment threatens the sovereignty of Idaho, and we will not allow it,” Attorney General Labrador said.

The Texas suit, filed in the U.S. District Court for the Southern District of Texas, challenges EPA’s proposed rule, while asserting the rights of states. Our office looks forward to challenging the Biden administration's overreach and defending the people of Idaho.
