Montepeque Update

Abner Montepeque was scheduled for sentencing on Monday, March 2nd 2020, from original charges filed in October of 2018 showing three counts of Rape-Resists but Resistance is Overcome by Force or Violence and five charges of Child Sexually Exploitative Material by Willfully Possessing or Accessing by Any Means. At his preliminary hearings scheduled for November 13th of that same year he waived his rights to a preliminary hearing and continued to be held on a $1 million dollar bond. In December 2018 at arraignment he pled not guilty to all eight felony charges at which time the state requested the two cases be combined and with no objection from the defense. He was scheduled for a Jury Trial in May 2019 that was later vacated. Court disposition records show he later pled guilty to one count of each in September of 2019. At the sentencing it was immediately asked that they go the judge’s chambers. After the short recess to chambers, Judge Cawthon acknowledged the defense’s request for a continuance saying that “based on discussions in chambers with the attorneys’, he would grant the request for a continuance.” No other information was provided. His sentencing is now scheduled for April 20th, 2020.
