Water and sewer district elections canceled due to inadequate notice

Wednesday, May 6, 2009

The scheduled May 26 elections for board members of the Mellen Water District and the West Side Sewer District have been canceled by the county clerk's office due to a failure to provide proper legal notices.

The elections have been reset for August, and according to Deputy County Clerk Vivian Garcia, who supervises elections for the county, "as far as I know, this is the first time in the history of the county that an election has been set aside."

Although both districts, which serve customers in an area that is technically outside city limits on the west side of town, properly issued legal notices announcing the election, both had failed to place the necessary legal notices in the newspaper advising voters how they could file petitions of candidacy, which also is required for any election.
