Addressing a question about recent spikes in gun sales, Obama blamed pro-gun groups for "ginning up fear" among firearm owners. "Those of us who look at this problem have repeatedly said that responsible gun owners -- people who have a gun for protection, for hunting, for sportsmanship - they don't have anything to worry about," he said. "The issue here is not whether or not we believe in the Second Amendment. The issue is are there some sensible steps that we can take to make sure that somebody like the individual in Newtown can't walk into a school and gun down a bunch of children in a shockingly rapid fashion." -----And what you are unable to get done through the Senate and Congress, just "fix" by Executive Order! Because we ALL know that guns killed all of those people in Newtown. Never mind that people knew "there was something wrong" with the shooter but CHOSE to do nothing. Never mind that an unstable person should not have been able to get their hands on firearms that were LEGALLY obtained. Never mind that these parents knew something was not right with their son but CHOSE to deal with the problem by not dealing with the problem. Never mind that this young man went into this school INTENT on killing as many people as he could with MANY guns and a bunch of ammo. Never mind that it was not even an assault weapon that killed all of these people. The weapon of choice for killing is a 9mm! If you are the only person with a gun in a room full of people and enter that room intent on killing---that is what you will do regardless of laws. People need to be held accountable! People are killed by stupidity each and every day in this country. Make that illegal (stupidity) and it will all fall into place. Some of the states with the toughest "gun control" have the highest death rates by people with guns. You would think that would be a hint/clue that "gun control" will not work because the criminals will ALWAYS have/find guns.
Yes, let us worry about the "things that matter" (in the words of another poster) like jobs, the economy and how we plan to pay off the debt created by none other than Obama himself. With all of this "gun control" we lose a key ingredient to population control. Just another way of looking at the situation. Night y'all!
What can we do to hold the Lanza's accountable?
Yes, mental health checks for everyone running our country too. They seem to be suffering from a type of narcissic syndrome.
We the People have become we the uneducated, unreasonable people in their eyes.
There seems to be a magic show going on and several of the performers are very sucessful in keeping people's attention away from the real issues, like their spending. The attendants are the media who purposely post stories to keep the illusions going.
We had a our chance to let those who work for us know that we aren't taking it anymore, but blew it.
This hasn't been about guns, debt or poor legislation. Instead, what we have seen is a slow moving mud-slide destroying everything that we hold dear in its path.
I've read this a couple of times and I'm not sure what the author favors.
It seems to advocate a hands off approach.

Well, lets see. How do we make parents of mentally ill or mentally impaired children or young adults accountable? How about the same mandate as what people who have young children in a house have? Trigger locks? Lock boxes? Gun safe?
Perhaps had those guns been locked up where this person could not get at them, this event would have never taken place. Perhaps if his mental illness had been dealt with, this event would have never taken place. Guess we will never know. Maybe if people were forced to pay for their stupidity (damages to all of these people), they would take more care in how they decide to deal/not deal with their children. I hold those parents 100% accountable for those shootings.
I do know one thing...the fact that Mr. Lanza did what he did was certainly not my fault but now we will all pay the price in the name of "gun control."
What a bunch of CRAP. KH, I agree with you 100%. We are going to gut this country before it is all said and done. Then everyone can stand around and say "who knew?" Or, "how did that happen...I did not even know that was going on."

How shall we be made to comply? How shall compliance be assured? Shall we be expected to let the Fed in the door at any time to allow for compliance inspection? If we're not in compliance shall that be justification for seizure or forfeiture?
Would any of us be willing to consent to a mental health evaluation of all minor members of our households? Is there a better way to assess a person in order to determine whether there is a likelihood that they may become irrationally violent at any moment? Clearly, family members cannot objectively evaluate their loved ones.
And if we don't consent shall we forfeit our 2nd amendment rights?

At a minimum, we owe it to ourselves, the victims and their families to base any dialog on factual data. And there is very little of that available.
The last official statement from the Connecticut State Police (the lead investigative agency) is dated January 4, 2013 and simply notes that there is no additional information "available".

I always thought it would be best if they began with the original, unamended version, and then after some pause for reflection, returned to read the amendments.
Maybe they'd see that there were some compromises made in the past.

I agree that mental health is a major part in this issue. The questions is how would it relate to preventing mass violence with a gun or otherwise? Do we require every person who wants to purchase a firearm, drive a car, or buy fertilizer to see a psychiatrist? And who will we hold accountable the next time this happens and the perpetrator wasnt' identified as mentally ill? I think that addressing mental health is should be a top priority but it's only one part of the solution.
The President has stated that if there is one thing that can be done that would save one life we should do it (not sure of the exact wording, might has said consider it). But the one suggestion that has been offered that would have immediate effect he seems to have dismissed. Wayne LaPierre suggested that we have security guards in every school. Don't get me wrong I am not a big fan of the NRA (even though I am a gun owner)nor any other lobbiest. But I do believe that a security person lilely would have saved at least one life and possibly many more at Sandy Hook.
And just a couple of hours ago, the President's press secretary stated that Obama would present "concrete" proposals at a White House "event" while surrounded by children and their parents who had written him about guns and school safety in the days following Sandy Hook.
Is there nothing that this administration WILL NOT DO in order to leverage a crisis?
Not all "gun lockers" have keys---some require combos, keys or both. If you have/had a mentally ill child in your home why would you:
1. Have a gun/guns in the house that is/are unsecured?
2. Have a gun/guns in the house and ammo in the house unsecured?
If I had anyone in my house that heard voices...the last thing I would have available to that person is a gun. There is always an excuse.
Deal with the economy, debt or lack of jobs in this country (re: wh67's question at 1:01 p.m.).
Why deal with that when you can create your own media circus and put laws in place that will do NOTHING to help people. Lip service. If I did not know any better I would think he was up for a third term!
I wiped out my comment by mistake. Mentally ill people will manufacture their own weapons if they want to do harm to themselves or others.
I know this to be true with my own experience.
Next: What needs to be controlled are the people who have unlimited access to our living rooms every night. Media, Celebrities and their self-righteous blather. All the while hiring body guards, enjoying security measures in the buildings that they work in.
Treatment services for those who are mentally ill need to be changed. Too many times, the system lets these people down by some type of red-tape. Medicating and release does not work. Nor does the fact that most doctors aren't interested in sucessfully treating an illness because the pay-out for medicare and other low income programs is a pittance.
Families of the mentally ill need to be heard from in treatment care. They are the ones who see all the dangers first hand.
I wonder what would happen if we started our own media network called We The People, where common sense prevails and stupid gets stopped at the door.
I guess OM that's why they are trying to control guns better, people are sick of excuses in this country.
TundraRat theres no certain answer and no quick fixes concerning gun violence in our country. Usually when a Schizophrenic has their first episode, there is no warning signs and that first time he or she could be violent.
I think there should be trained security at every school door in America. Are children are not safe in this country.
I have been diagnosed with PTSD from events that occured during my years of serving in the military. When this rolls out, I will probably never be able to buy a gun again. I am not crazy, I will never be a mass murderer and I am certainly a responsible gun owner. There are hundreds of thousands of veterans, both on active duty and seperated, just like me who will be put in the same situation.

Loss of interest in friends
Declining self-care/hygiene
Lack of motivation
As you can see the warning signs could fit anyone under stress or depression without being a schizophrenic

I skimmed it briefly and it is pretty extensive, but it does contain provisions that allow for the confiscation and destruction of personal weapons as well as requiring mental health professionals to report personal information to the state in certain cases.
I can see the ACLU challenging the mental health reporting requirements as invasions of privacy. I am certain the gun owners will mount challenges as well.

Interesting episode of Frontline tonight.
Just to add a bit to the mental health discussion, I am going to tell a bit about a young lady I know. She does not suffer from mental illness, but impairment. She is an adult living with Fetal Alcohol Syndrome. To help you understand her capacity, she told me a few weeks ago that she had a fever because her temperature was 70 degrees.
Anyway, she has a baby. Never should have happened, but it did. She does not have custody, however she is fighting for it. She has lawyers for this. Fine. She also works with a group here in town (can't recall the name) and those folks help her with things like rent and finance management. (she does receive benefits due to her condition and works a very part time job) So she has these people who help her. However, probably because of our hands-off PC society, nobody helps her with decisions regarding right and wrong. She is old enough (chronologically) to go to bars and she often makes questionable decisions about where to spend the night. She sees nothing wrong with this, and does not understand when others try to tell her that, even if we do not talk about it being right or wrong, it is still not a healthy and proper way to take care of yourself.
The point is that we cannot address any type of mental health issue without addressing right and wrong with it. We have become a society afraid to talk about that because we are "supposed" to be tolerant of everything different from our own individual view.
That's my rant.

I am not a hard leaning right wing person nor do I lean left.
I am not whining about who has what opportunities and who doesn't only the hypocrisy of those who could take their funds and TV time to provide a public service worth having. The massive amount of money spent to convince a voter that a candidate is the "One" could have been used to pay a substanial amount of debt, or provided other services that otherwise may have been cut from charities due to the turn in the economy.
There is a thing called stewardship and it is sadly lacking on all levels of society today. Stewardship doesn't just exist for monetary reasons, but moral ones too.
Accountability is another missing element from our society. If you can spin it or brazen it out long enough, people forget that you were ever in trouble. They praise those who "conquer" drugs, alcohol and other issues, but fail to congratulate those who really try to make a difference in the world.

RE: NY Gun Law
The main problem I have with the law is the extent that the measure defines and restricts the gun related portions while leaving the mental health side undefined and without consequence.
For example, a gun owner is mandated to report the loss or theft of ammunition within 24 hours after discovery while the mental health professional is allowed to report at his/her convenience. The penalty on the gun owner is a misdemeanor charge (at minimum) and there is no penalty at all for the medico.
Given that the majority of recent cases involve mentally unstable offenders, I would think that prompt reporting would be extremely desirable. And since the mental health profession has it's own licensing and practice standards, a misdemeanor penalty would provide an added incentive to comply and bring the two sides of the problem into a more balanced status.

I don't find it particularly extreme. It clearly states his position to uphold the Constitution (as his oath of office requires)for the immediate future. Should his constituents disagree, he will pay that price in the next election cycle.

The only thing I see regarding seizure relates to the fifth item on the list, "Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun."
I have noted that this addresses R E T U R N I N G a seized gun.
Why would a group so bent on seizure of our guns waste our time developing new rules to help law enforcement return a seized weapon.
Since when is it appropriate for law enforcement to render decisions on the Constitutionality of the laws they uphold? Any questions regarding Constitutionality are answered by a different group of professionals.
What I DON'T see anywhere on the list are provisions to provide "we the people" with access to the data that currently exists, that is to be shared and has previously been collected but is inherently comparmentalized in the multitude of federal datbases.
How are stakeholders on either side going to enter into a meaningful dialog without that?
I will express this concern to my elected representatives and encourage all to do the same.

My interest is purely with the data itself. I have no interest in my neighbor's gun ownership (or lack thereof for that matter).
However, I have made a number (perhaps 20 or so) of "over the counter" gun purchases in the past 45 years. Since 1968, each of those purchases required the completion of a FFL 4473 or its equivalent. Of those purchases, I still own four, one was stolen, one was given to a friend's son on his 12th birthday, and the rest were sold privately.
Unfortunately, that renders the ONLY known record of those 20 or so weapons invalid.
As the saying goes, garbage in garbage out.

The "problem" has existed for all of recorded history and has little to do with the rule of law.
But risk mitigation can be part of a solution.
Codified electrical standards reduce bring associated risks to an acceptable level, but don't completely eliminate the risk. But we still make an effort to minimize the risk.

Would you say an incident rate of 26,000 (out of a hundred million or more) is an "acceptable" risk level that does not require banning the sale of extension cords?

For example, there are 29 counties in Utah and 28 of the 29 county sheriffs' names are indeed on the letter I referenced.
Further, the letter makes no mention of taking guns, (nor did I) but simply and strongly states that these men do not support taking away rights granted by the 2nd Amendment.
Further, the letter was dated January 17, 2013.

If marijuana pharmacists are convicted in violation of federal drug laws, in spite of the fact that the state they are operating in has given the thumbs up to the legalization of marijuana, would those pharmacists surrender their Second Amendment rights?
If an individual in this state were convicted of violating federal marijuana laws, would that individual surrender their Second Amendment rights?
A third conviction for possession would result in forfeiture of second amendment rights, as it carries a minimum sentence of more than two years.
Conviction for sale or cultivation would result in forfeiture on the first offense.
At least that's how I understand it.

I'm not all that sure myself. It looks to me like it depends on who makes the arrest as to exactly which sentence would apply. And I suspect the plea bargaining/final outcome could apply.
Not to muddy the waters, at one time, muzzle loaders and other primative weapons (cross bows, compound bows, etc.) were legal, even for felons I think? And I know firearms made before a certain date don't fall under federal firearms laws because they're considered antiques. But I've seen references that say anything that "shoots a projectile" is fair game in some jurisdictions.

OM: 1) Could you please clarify what you know about how the Lanza's 'dealt' with their child's mental health condition, if that is in fact what you were referring to in your blog? If so, what 'problem' do you suggest they ignored? His mental health? Or the risk of keeping firearms in the home with an unstable resident? ...or if I am missing the problem entirely?
2) Do you suggest the Lanza family ought not be afforded the right to bear arms because of their son's condition, whatever it may be?
3) Would you be a proponent for an increase in mental health resources/education for parents/families of young at risk people? The problem with society today is that few are accountable. It is always the fault of another---or some "system" that has failed. Sure, we can blame it on crappy healthcare in the area of mental health. Sure we can blame it on a lack of insurance coverage for extended stays in a facility. People these days have little respect. We live in a society where most everything is EXPECTED. People are "ENTITLED." We are "owed" this and that. What a bunch of pooh-pooh! These things were in my parents master bedroom---where kids were not free to just help themselves to what was there. Back then, we had respect for rules and our parents. It was just better to follow the rules and skip the wrath/disappointment.

It is always the fault of another---or some "system" that has failed. Sure, we can blame it on crappy healthcare in the area of mental health. Sure we can blame it on a lack of insurance coverage for extended stays in a facility. Lack of money for meds, etc. There are all kinds of reasons---true or not.

They are not excuses they are facts. I'm not saying an insane person should go unpunished, I am saying cuts in Mental Health Programs have put insane people out on the street. This is true not an excuse its a fact. Most Insurance Companys don't even give you enough money for a 3 stay in a mental hospital. When the insurance runs out they release them from the hospital still insane. Read the 2012 legislation issues

I've looked back on this thread and all I saw was an affirmation of your belief that no one is coming to take our guns. I agree.
For a group of people who go on about how inefficient the government is, they sure have alot of confidence that their much feared government run gun confiscation program will be run with uncharacteristic efficiency.

I don't know how one can be sworn to uphold the Constitution, and yet justify "over-riding" law enforcement as the "right thing to do".
There are Constitutional means to challenge the constitutionality of laws.
I don't think there's a provision that allows law enforcement to declare a law unconstitutional.

Senators have challenged President Obama's recess appointments. In court. Now the President may choose appeal to the Supreme Court. That's the way the framework is laid out.
Why isn't that same framework (The Constitution) good enough for you to use?
If there's one thing that disappoints me about Idaho sportsmen, it's going out to walk or shoot and coming across a spot where someone had been out shooting and left a bunch of empty cold packs, shotgun shells, broken bottles, etc. lying all over the ground.
This area has a unique beauty and I hate to see it spoiled by someone who has no appreciation of that.
