Qualifications/Guidelines To Serve On WECRD Board---Legal Or Not?

In a letter from the State of Idaho Office of the Attorney General dated April 15, 2009:

"In addition to the qualifications required by Idaho statute, the recreation district (WECRD) has established other eligibility criteria for consideration to serve on the board. The following criteria are published:"

"Must be at least 21 years of age

Knowledgeable of Idaho Recreation District purposes

Involvement in the community

Involvement with the WECRD

Ability to communicate (verbally and written)

Knowledge of recreation, health, families, community

Willingness to learn

Willingness to assume and execute WECRD tasks

Supportive of WECRD mission"

"Does the board have the authority to set and enforce these additional qualifying standards?"

"If these standards were established as guidelines for the board to use in appointing someone to serve on the board, then they are valid criteria. In other words, if they are guidelines, which each member of the board may consider when appointing someone to fill a vacant position, then they are probably valid. If, however, they purport to establish additional standards other than those included in Idaho Code, which would disqualify as otherwise qualified candidate from serving, then they are beyond the authority of the board of directors."

...........

"The district and the board are without any authority to establish additional criteria. Certainly, the board, should it need to fill a vacancy, may set forth guidelines to be considered by board members in evaluating candidates. However, these guidelines would not be binding on the directors who are appointing someone to fill the vacant seat. Likewise, they could not be used to disqualify an otherwise qualified candidate who seeks to be appointed to a board position."

It was well documented on the BB (Banter Box) that the last two (2) guidelines from above kept several people from throwing their hat in the ring for the seat vacated when Dee Pate resigned (it is now Marsha Seller's board seat).

How does this make you feel? What is your opinion with respect to the above? Do you feel this was legal?

It seems like the current board is lacking with respect to some of their own "guidelines." Funny how you can get away with that when you write your own rules.

The name should be spelled WRECD

You are correct! However, in an effort to not confuse...I will keep it, in formal circles, as the WECRD.

I have lived in Mountain Home for over 11 years now. I love to be outdoors in wide open spaces (as long as it does not involve camping...in a tent and an out house). I dislike Government waste/abuse of tax dollars and "sky is the limit" spending by those that we elect to represent "us." I am 38 years old and married to a guy who is active duty USAF (and a Cubs fan...he is the "perfect" one).
